No jail time for man who caused deadly wreck on Highway 99

The man who caused a deadly wreck near Junction city was sentenced Friday, pleading guilty to criminally negligent homicide.

Well now I have to introduce you to the REAL world. When you get in serious trouble with the law the smartest thing you can do is hire a VERY ($) astute lawyer. A good lawyer knows all the doctors in town and (yes this is shady) hire them to testify on the stand to say WHATEVER helps... Case in point- we just had a trial that ended in a hung jury not so long ago- the one where the young woman was accused of giving birth to her baby and murdering and disposing of the body. Funny, there were doctors on both sides that testified-one said she DID give birth, the other said she did not. So you will have to EXCUSE me if I am rightly cynical about this "narcolepsy" diagnose... I believe this man was tired and drunk and caused the death of the young woman. You don't suddenly have narcolepsy without knowing it- get a grip.

The problem for me is the blood alcohol content (BAC). A man of average body weight will metabolize alcohol at about .02 per hour, meaning that if he'd been tested at the time of the accident—instead of three hours later—his BAC would have been .12, well above the legal definition of intoxication in Oregon .08. Seems the police are to blame for the injustice, they should have tested him much earlier.

@007getagrip, first you should probably re-read the story - it says he claimed to have "3 beers" not two. Second of all, there is nothing to indicate he was drunk at the time of the accident just because he had been drinking heavily the day before - hence day before not being the same day. If the court felt that it could be proven that alcohol played a role in the crash and subsequent death, they would charge for that regardless of race!

Rhimea- your perfect RACIST response only supports exactly what I said as true! Ha! LOL! You need to read it over again -he had been drinking heavily the day before and claimed (claimed yea right) he had only had 2 beers THAT day- tired and drunk= Andrea Post's death. Get a grip.

It wasn't caused by drinking and driving, they tested him. It was caused by undiagnosed narcolepsy. You read about as well as a 19 year old latino.
