Deadly car crash results in 10 year prison term

A judge has sentenced a Eugene man to 10 years in prison, followed by three years of probation, after his conviction for manslaughter, assault and reckless driving.

WHAT WASN'T MENTIONED IS THAT ALSO THE KOREANS WERE NOT MADE TO WEAR SET BELTS IN THEIR COUNTRY. THE PASSENGER KILLED IN THE FRONT SEAT SLID UNDER THE DASH IN FRONT AFTER BEING STRUCK BY THE REAR SEAT PASSENGER AS THEY WERE FLYING OVER THE SEAT AND WAS KILLED THAT WAY. HE WOULD HAVE MADE IT OUT ALIVE IF IN FACT HE HAD HAD HIS SEAT BELT ON AS REQUIRED BY LAW. NONE OF THE KOREANS WERE WEARING SET BELTS BUT THE DRIVER AS REQUIRED IN KOREA. ALSO THE KIDS IN SCHOOLEYS CAR WERE NOT HURT MUCH BECAUSE THEY WORE THEIR BELTS. YES IT WAS A TRAGIC ACCIDENT, BUT THE KOREAN KIDS WERE ALSO SPEEDING AND SHOULD ACCEPT SOME BLAME FOR NOT HAVING SEAT BELTS ON.

Measure 11 is wrong. It's a blanket law that treats everyone the same. And in this case, one mistake and this man is treated like a hardened criminal when he has no priors. I'm not disregarding that someone died, but it was an accident. Plus they definitely don't have enough information. It's very sad that if he was drunk he would be better off. What's that say for our justice system?

@OrCity: When did measure 11 pass? Was it in effect 7 years ago? I'm curious as to why the woman who killed my son's father wasn't sentenced under it. She certainly fit your (a) definition. If gender doesn't play a role in sentencing, then it must in what the charges are.

@kenkire: The fifth W is Measure 11. One of the charges was manslaughter. Under Measure 11-- passed by Oregon's voters-- the mandatory minimum sentence is 10 years, no parole, no exceptions. Here's the statute on manslaughter: "163.118 Manslaughter in the first degree.(1) Criminal homicide constitutes manslaughter in the first degree when: (a) It is committed recklessly under circumstances manifesting extreme indifference to the value of human life..." And he was convicted on that basis. Don't like it? Talk to your state representative.

I really wish your reporters did some reporting. It would be nice to know more facts of the case. Remember the 5 Ws? Well you missed one. Why. Why was he convicted so harshly? Please start adding more details to your stories. It would be nice to get all the facts from one place.

Am I missing something??? Why are they being so harsh on him? Was he drunk? Driving way too fast? Driving without a license? There are many other offenses out there that could have used a sentencing like this yet they don't get squat!!!

And yet the woman drunk driver who slammed my son's father into a cement post and killed him, served less than 1-1/2 years and was released early. Did I mention that at the time of the accident she had been undergoing classes for a previous drunk driving arrest? And when asked why she lied and didn't mention there was someone else in her wrecked car she said because "he didn't matter, wasn't important". Why so lenient with one and so strict with the other? Does gender play a role in sentencing?
