EUGENE, Ore. (KMTR) -- Eugene Police has released the name of the woman killed in a
West Eugene crash early Wednesday morning.
43-year old Toni Lynn Bryson of Eugene died Wednesday, March 7th, 2012, along with 62-year old Richard Lee Taylor, after their truck was hit in a high-speed collision at the intersection of West 11th Avenue and Bertelsen Road in West Eugene.
The driver who allegedly caused the crash, 16-year old Emmanuel Harrara-Gutierrez is charged with two counts of manslaughter and two third degree assault.
Under Oregon’s Measure 11 law, Herrara-Gutierrez can be tried as an adult.
Eugene Police say Herrara-Gutierrez was original clocked by an Oregon State Police Trooper doing more than 100 miles-per-hour in a Nissan Maxima on the Beltline Highway at 12:31 a.m. on Wednesday. Police say the teen does not have a license.
Police say Herrara-Gutierrez original stopped for the trooper, but then sped off, running a red light at the intersection of W. 11th Avenue and Bertelsen Road and hitting a Chevy S-10 pickup truck.
Bryson and Taylor were ejected from the truck on impact and pronounced dead shortly after.
A Eugene Police patrol car sitting at the intersection was also hit in the crash. One officer was treated and released for minor injuries as a result of the crash.
Herrara-Gutierrez was treated at a local hospital for injuries. He is now being held at the John Serbu Youth Center juvenile detention facility in Eugene.
Herrara-Gutierrez was arraigned on Wednesday at the Serbu Youth Center.
The teen has waved his right to a have a grand jury review his case for indictment on charges within 7 days of his arrest. That means investigators will have more time to put together information for a grand jury. A grand jury review will likely come sometime in the next 35 days from his arraignment on Wednesday, March 7th, 2012.
Herrara-Gutierrez has not waived his right to trial within 60 days of his arrest. He’ll be back in court on April 2nd, 2012, for a “35-day call back” or a status check hearing. There, a judge may set a plea date, a settlement conference or receive a settlement.
A jury trial is still a possibility in Herrara-Gutierrez’s case.
